Terms of Service

These Terms of Service ("Terms") govern your use of the Tendril mobile application and website (collectively, the "Service") operated by Chris Giglio ("we", "our", or "us"). By downloading or using the Service, you agree to be bound by these Terms.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information when creating your account
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

Subscriptions and Auto-Renewal

Tendril offers optional auto-renewable subscription plans ("Gardener" and "Grower") that provide access to additional features beyond the free tier.

• Billing: Subscriptions are billed monthly through your Apple ID account at the price shown at the time of purchase.
• Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Renewal charge: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Price changes: We will notify you of any price changes in advance. Continued use after the change takes effect constitutes acceptance of the new price.

Managing and Canceling Subscriptions

You may manage or cancel your subscription at any time through your Apple ID account settings. Go to Settings > [your name] > Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date. We do not offer refunds for partial subscription periods.

Free Tier

A free tier is available with limited features, including a maximum number of plants, photos per plant, and AI diagnosis scans per month. Free tier limits are subject to change with reasonable notice.

User Content

You retain ownership of any content you submit to the Service, including plant photos, journal entries, and notes ("User Content"). By submitting User Content, you grant us a limited license to store, process, and display that content solely to operate and improve the Service. We do not claim ownership of your content.

You are responsible for ensuring your User Content does not violate any third-party rights or applicable laws. We reserve the right to remove content that violates these Terms.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Upload content that is harmful, offensive, or infringes on the rights of others
• Reverse engineer, decompile, or attempt to extract source code from the Service

AI Diagnosis Disclaimer

The AI-powered plant diagnosis feature is provided for informational and educational purposes only. Diagnoses are generated using third-party AI services (Anthropic Claude) and plant identification APIs (Plant.net) and may not be accurate in all cases. The Service is not a substitute for professional horticultural or agricultural advice. We are not liable for any plant loss or damage resulting from reliance on AI diagnosis results.

Intellectual Property

The Service, including its design, code, and content (excluding User Content), is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by using the in-app account deletion feature or by contacting us at support@tendrilgarden.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

Apple App Store

If you downloaded the Service from the Apple App Store, you acknowledge that these Terms are between you and us only, not with Apple Inc. Apple has no obligation to provide maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the Service.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
